Japan Chamber of Commerce and Industry New York, Inc. (“JCCI”) is a non-profit organization. JCCI’s website is found at www.jcciny.org (“Site”) and contains webpages with information and services that visitors may access and utilize. Certain webpages on the Site, and the information and services contained on those webpages, may be accessed only by members of JCCI. Your access to and use of the Site, whether as a member of JCCI or a non-member visitor, is subject to the following terms and conditions (“Terms and Conditions”) and the privacy terms set forth in the accompanying privacy policy (“Privacy Policy”). If you do not agree to be bound by these Terms and Conditions and by the Privacy Policy, you must not access JCCI’s Site.

  1. Changes to the Terms and Conditions or the Privacy Policy. The Terms and Conditions and the Privacy Policy on the Site comprise the current policies of JCCI concerning the use of its content on the Site. JCCI reserves the right to modify or amend the provisions of the Terms and Conditions and/or the Privacy Policy at any time, at its sole discretion. Any modifications to the Terms and Conditions or the Privacy Policy will be posted on the Site and will be effective on the date they are posted. Therefore, each time you access or use the Site, you accept and agree to be bound by the most current Terms and Conditions and Privacy Policy. To ensure that your access to and use of the Site conforms with JCCI policies and procedures, you are urged to check for the most updated version of the Terms and Conditions and the Privacy Policy.
  2. Disclaimer. JCCI cannot and does not guarantee or warrant that any data, information and/or material (“Content”) that you may obtain through the Site is accurate, complete, useful, upto-date and/or complete, and JCCI does not accept any responsibility for any errors or omissions on the Site or for any damage or loss you may suffer as the result of your use of the Content. Statements and opinions expressed by persons who have authored articles contained in JCCI’s newsletter or otherwise posted on the Site do not constitute statements of JCCI, but only reflect the author’s personal opinion, and JCCI shall have no responsibility or liability for such statements or opinions. You are solely responsible for the consequences of your use of any Content on the Site.
  3. Member Only Pages. Business entities, other organizations, and qualified individuals are eligible for membership in JCCI, which allows them access to Content that is not available to non-members. A business entity or organization desiring to become a member of JCCI (“Member”) must complete a membership application (available here), and upon approval of the application and payment of membership dues and fees, will be deemed a Member and have the ability to create an account for Member access to the Content that is restricted to Members. JCCI provides Members with account credentials. Members who believe their password or other account credentials have been stolen or compromised must immediately notify JCCI so that action can be taken to address the breach.
  4. Blog Entries. Information about events held or to be held by JCCI is posted on the Homepage on the Site. The full text of each entry is hosted on www.jccinyblog.wordpress.com (“Blog Page”) which is operated by Automattic Inc. (“Automattic”), a third party service provider. When you click to view a blog post, you will be transferred to a site owned and operated by Automattic and will be subject to Automattic’s privacy policy, which can be accessed at https://automattic.com/privacy/ and cookie policy at https://automattic.com/cookies/. Please carefully read the privacy statements or notices of Automattic before reviewing a blog entry. AUTOMATTIC IS A VENDOR OF JCCI—JCCI DOES NOT CONTROL AND IS NOT RESPONSIBLE FOR PRIVACY PRACTICES OF AUTOMATTIC. ANY PERSONAL DATA AUTOMATTIC COLLECTS FROM YOU IS NOT COVERED BY JCCI’S PRIVACY POLICY.
  5. Leaving Comments. If you are 13 years or older, you are welcome to leave comments regarding a blog entry posted on the Blog Page. The Terms and Conditions and the Privacy Policy of JCCI and Automattic’s rules apply to all comments posted on JCCI’s Blog Page. By submitting a comment, you agree that you are solely responsible for the statement you post (including any hypertext links or other links included in such post), and you acknowledge that the disclaimer set forth in section 2 of the Terms and Conditions is applicable to such statements. You agree to indemnify and hold JCCI harmless from any and all claims asserted against JCCI and any damages and/or liabilities assessed against JCCI with respect to any statement or comment posted on JCCI’s Blog Page. JCCI has the absolute right to remove any comment that (i) uses abusive, vulgar, offensive, and/or threatening language; (ii) includes personal attacks against any individual or group of people and/or fosters or communicates bias or discriminatory treatment against any person or group of persons based on race, color, sex, gender, gender identity, national origin, disability or any other category protected by applicable law; (iii) advocates, promotes or assists any unlawful act or conduct; or (iv) in JCCI’s sole discretion is not consistent with JCCI’s mission or purpose. By leaving a comment, you grant JCCI a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable right to exercise the copyright, publicity, trademarks, database rights and intellectual property rights you have in the comment, in any media known now or in the future. In addition, you waive all moral rights you have in the comment to the fullest extent permitted by law. You represent and warrant that you are entitled to grant such a license to JCCI.
  6. Third Party Sites. JCCI provides hypertext links or other types of links to certain online resources that can be accessed from the Site. However, these sites are not maintained or controlled by JCCI; therefore, JCCI is not responsible for the contents or accuracy of any such linked resources. JCCI makes no warranty, express or implied, with respect to the use of the links provided; nor does JCCI guarantee the accuracy, completeness, usefulness or adequacy of any resources, information, system, product or process available at or from the Site. You should be aware when you leave the Site to access such hypertext links or other links, and should read the privacy statements or notices of each website or app that you access to ensure your understanding of and agreement with the terms and conditions and privacy policies of such websites or apps.
  7. Advertisements. Members may place advertisements on the Site. Advertisements posted on Blog Page are not posted by JCCI; they are posted by the host. JCCI does not endorse or recommend any products, process or services or entities promoted in advertisements posted on the Site or the Blog Site.
  8. Copyright Notice. Copyright on all materials, including, without limitation, Content and photographs (“Materials”) available on the Site belongs to JCCI or its licensees. Any and all use of such Material without express authorization of JCCI or its licensees is at your own risk. Title to copyright in Materials on the Site will at all times remain with JCCI and its licensees. Any permitted copies of the Site or portions thereof must retain any copyright notices and other notices thereon. Nothing on the Site shall be construed as conferring any license under JCCI and/or its licensees’ rights, whether express, implied, or otherwise. You may not reproduce or transmit in any form or by any means, electronic or mechanical, including photocopying, recording, and storage in an information retrieval system, nor may you modify or create derivative works based on the any part of Materials.
  9. Availability of the Site. While JCCI will endeavor to maintain the availability of the Site, JCCI makes no warranty that the Site will meet your requirements or that access to the Site or any webpage or other information on the Site will be uninterrupted, timely, or error-free, that defects will be corrected or that the Site or the server(s) that make the Site and/or the services available through the Site are available free of viruses or bugs. If you are aware of any error on the Site please contact JCCI and we will endeavor to correct it.
  10. Emails. By providing your email address to JCCI, you agree that JCCI may send you emails regarding your use of the Site, information about upcoming events at JCCI, and JCCI’s newsletters.
  11. No Warranties. JCCI shall not be liable to you for any loss arising out of use of the Site or the Blog Site or the inaccuracy or incompleteness of information contained on the Site or the Blog Site or in the services available through the Site. THE SITE AND INFORMATION ON THE SITE AND THE BLOG SITE ARE PROVIDED TO YOU “AS IS” WITHOUT WARRANTY OF ANY KIND, EXPRESSED, IMPLIED OR STATUTORY, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. YOU AGREE THAT YOU BEAR ALL RISKS ASSOCIATED WITH, ACCESS TO AND USE OF THE SITE, INCLUDING WITHOUT LIMITATION, ANY RELIANCE ON THE ACCURACY, COMPLETENESS OR USEFULNESS OF ANY DATA, INFORMATION, AND/OR MATERIALS AVAILABLE THROUGH THE SITE.
  12. Limitation of Liability. JCCI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY OR PUNITIVE DAMAGES OF ANY KIND, UNDER ANY CONTRACT, NEGLIGENCE, STRICT LIABILITY OR OTHER THEORY, INCLUDING WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, USE, DATA, LOSS OF OTHER INTANGIBLES, LOSS OF SECURITY OF INFORMATION YOU HAVE PROVIDED IN CONNECTION WITH YOUR USE OF THE SITE, OR UNAUTHORIZED INTERCEPTION OF ANY SUCH INFORMATION BY THIRD PARTIES, EVEN IF ADVISED IN ADVANCE OF SUCH DAMAGES OR LOSSES. This privacy policy (“Privacy Policy”) forms part of the Terms and Conditions of use of the website of the Japan Chamber of Commerce and Industry New York Inc. (“JCCI”) located and accessible at www.jcciny.org including pages accessible therefrom and services available therefrom (the “Site”).

  1. Changes to the Privacy Policy. The Privacy Policy on the Site comprises the current privacy policies of JCCI concerning the use of its Content on the Site.     1. JCCI collects business information about its members including business email addresses for a member’s executive officers that is provided by members to JCCI.
    2. JCCI may collect personal information, such as name, address and contact information that you agree to provide to JCCI. JCCI may, in conjunction with transactions, ask for and collect certain personal information about you, including identifying and contact information or credit card information for purchasing tickets to events organized by JCCI.
    3. JCCI does not share, provide, transfer or sell personally identifiable information it collects from individuals with anyone.
    4. JCCI does not use any cookies and/or other software to collect any personal information from any user of or visitor to the Site.

  6. It is JCCI’s policy to cooperate with law enforcement agencies and other governmental organizations. JCCI can, and you authorize JCCI to, disclose any information JCCI has about you to law enforcement or other governmental officials as JCCI, in its sole discretion, believes necessary and appropriate in any investigation of fraud, intellectual property infringement, or other activity that may be illegal or that may expose JCCI to possible liability.
